This Ethics CLE examines the interplay between Generative AI (“GenAI”) and copyright law, as framed by Melissa Rogozinski’s recent article, AI Copyright: Ethical and Legal Considerations for Legal Marketing and Sales.
In this 1-Hour Ethics CLE, you will learn:
• Practical business and legal impacts of GenAI in the legal marketing context
• How ethical rules and the uncertainty of pending regulation adds complexity for lawyers navigating this rapidly evolving technology landscape
• The current state of copyright law, including ownership of AI outputs and the potential for copyright infringement issues
• How the legal market is adapting to GenAI, including law firm strategies for training attorneys in its responsible use.
Regulatory considerations to be discussed include the recently outlined White House Executive Order on AI, and whether standing orders in federal courts around the country provide insights into how the courts may regulate use of GenAI in the judicial process. The session will place emphasis on ethical guidance found in the American Bar Association Model Rules of Professional Conduct and ABA Resolution 112 (2019), as well as the significance of the ABA’s formation of a Task Force on Law and Artificial Intelligence.
