One of the biggest challenges facing clients and counsel today is navigating the settlement process during high-stakes, complex litigation and/or class actions. This course, presented by Wyatt Partners (a corporation that focuses exclusively on evaluating both legal spend and litigation settlements), addresses today’s hot topics on this timely issue – both from an in-house and outside counsel perspective.  Settlement of a complex piece of litigation can be a difficult, lengthy, and multi-faceted process.

This course will provide comprehensive guidance on the following topics:

Factors and risks (both general and specific) to be considered when determining whether to settle

Factors to be considered with respect to the fairness and efficacy of the settlement

Identification and necessary involvement of key players in the process

The content and parameters of the ultimate Settlement Agreement

The process for approval of the settlement (if judicial approval required)

The potential for payment of attorneys’ fees/costs, the reasonableness of same, and factors to be considered when assessing the reasonableness

Potential impact of insurance coverage on the settlement and navigation of interacting with insurers during the process

Identifying, evaluating, and managing other variables that may impact the settlement, including enforcement-related issues.

The program will also specifically focus on applicable Rules of Professional Conduct and case law when valuing a settlement, as well as the wide foray of experience our speakers have gained serving as experts across the United States and internationally on the issue of settlements. Both law firms and corporations will benefit greatly from such insights on a timely and evolving topic that affects everyone in today’s legal and business market.
