From a niche digital curiosity to a burgeoning industry with millions in revenue seemingly overnight, NFTs bring with them complex legal questions about ownership, licensing, and regulation. The program will provide a brief background and overview of the technology underlying non-fungible tokens (NFTs) and corollaries to previous technological disruption involving intellectual property. The program will also review in-depth legal principles that should be considered by all practicing attorneys when dealing with NFTs. While issues surrounding NFTs have not been thoroughly examined by the courts, we will review a few examples when NFTs have been central to a claim brought by litigants. The program will conclude with a discussion about potential legal issues to consider and future developments in the NFT space.
