This CLE presentation uses the Karton v. Ari Design & Construction Inc. (2021) 61Cal.App.5th 734, decision as a case study to identify and analyze both the ways in which attorney’s fees are calculated under the lodestar method and percentage-of-recovery method, and how those fees may be potentially reduced due to the incivility of counsel. It is also the objective of this presentation to impart to attorneys potential ethical issues related to civility, and how being uncivil may also have a negative impact on recoupable attorney’s fees under ABA Rules of Professional Conduct 1.3, 3.1, and 8.4.
