Part 2 of 2 - Lawyers at all levels of experience and even sophisticated law firms and general counsel offices sometimes run unwittingly afoul of conflict questions which can lead to disqualification or even potential malpractice or other liability. To help avoid getting tripped up by these issues, this program focuses on identifying and dealing with conflicts or potential conflicts in light of recent caselaw and other developments.
The presenter, a former firm general counsel with many years of experience, will review the conceptual and practical aspects of conflicts management and the approach taken by lawyers, courts and ethics bodies. After a brief review of conflicts basics, Part One of the course delves into issues which pose recurrent problems for lawyers including prospective clients, lateral hire’s former client relationships and screening mechanisms. Part Two of the course focuses on sometimes more subtle questions and emerging issues such as material limitation conflicts and issues arising in joint representations. It closes with a discussion of the role of advance waivers and their relationship to client guidelines.
