Whether the internal investigation involves sexual harassment, defalcation, diversion of trade secrets, or other impropriety, its competence will have substantial consequences for the person being investigated and the employer. Just as a good investigation may provide a legal defense to some claims, a defective investigation can result in liability for the employer.
