Cases are won or lost based on the jury’s perception of the merits of your case. That perception is shaped by the prism through which the jury views your case. The case theme provides the prism and answers the question of why your side is morally justified in the positions it has taken. In this session of our ongoing popular series of programs on key aspects of trial and trial preparation, presented by Jones Day partners Tom Jackson and Mike Ginsberg, the focus is on developing the ideal prism for the case and how that prism is developed through each direct and cross examination.
