In this Ethics program, Tom Gorman assesses the new Department of Justice standards on organization cooperation and their impact on the attorney-client privilege, the work product doctrine and the so-called "culture of waiver." Also discussed and evaluated is the suggestion that business organizations conduct at least part of any internal investigation without the use of counsel to avoid any question of privilege waivers in furnishing materials to the government as part of its inquiry.
