Strengthening the Electoral Count Act of 1887 will cover first a brief history of the Act, a product of the disputed Hayes-Tilden election of 1876-77. Thus, lawyers and others who participate in the Podcast will learn about the events of January 6, 2021 which involved applications of many provisions of the Act to the counting in the Joint Session of Congress that was interrupted by the Capitol riot of the 2020 presidential elector votes. The Podcast will then focus on various House of Representatives and Senate analyses and proposals to amend the Act, including the February 2022 King/Klobuchar/Durbin Discussion Draft and the Collins/Manchin bill, S.4573, of July 20, 2022. Included in the materials are the Committee on House Administration excellent analysis of the issues, published on January 2022. Finally, included is the Lofgren/Cheney Act, HR.8873, and the House of Representatives debate of its passage on September 21, 2022. Any Senate action with respect to these issues will probably happen after the time of submission of the Continuing Legal Education materials. It will be covered orally in the Podcast.
