Join Kay Gordon and Philip Morgan of K&L Gates LLP as they examine types of renewable energy projects and funds, typical legal structures used internationally for renewable energy funds, and some common legal terms used in such funds. Also explored are: (a) legal and financial drivers for renewable energy investment both in the US and the EU, in particular, both US and EU stimulus packages; the likely impact of the renegotiation of the Kyoto Protocol taking place in December 2009; and the American Recovery and Reinvestment Act of 2009, which provides for tax credits and grants for certain renewable energy property investments; (b) and the possible impacts on the international fund markets of both US legislative initiatives (such as the US registration requirements for private funds and their managers) and the proposed EU Alternative Investment Fund Manager Directive (including its potential impact on the ability of US managers to market renewable energy funds in the EU).
