Private equity real estate funds are an important source of capital to the real estate industry, particularly because they provide significant flexibility in pursuing various real estate objectives. In this installment of our new series on real estate and financing hot topics in 2009, Kay Gordon of K&L Gates LLP discusses why the private equity real estate funds are used and issues arising with forming a private equity real estate fund; explores trends in investment strategies and leverage (including traditional subscription facilities and after-care facilities and project level financing); addresses the legal structure and typical business terms of private equity real estate funds, and conflicts of interests affecting such funds; and discusses the role of mega-private equity interest and other trends in international real estate finance.
