In the past few years, organizations spanning the continuum of international political and economic unions down to individual states of the USA have implemented regulations relating to data privacy, control and the breach of such information. From the Health Insurance Portability and Accountability Act (HIPPA) and General Data Protection Regulation 2016/679 (GDPR) to more current Acts such as the California Consumer Privacy Act (CCPA) and New York SHIELD Act, the legal industry has been required to change business processes and computing procedures to react and comply with the changing legislative landscape. This session will focus on the current state of regulatory activity, provide current trends and best practices in the area of technology compliance, and focus on how attorneys must comport themselves in these areas as is related to ABA Model Rules 1.1 (Competence), 1.4 (Client Communications) and 1.6 (Confidentiality).
