This presentation addresses the basics and the nuances of conducting a deposition. It uses as a basis the Federal Rules of Civil Procedure (and in at least one instance, the Federal Rules of Evidence), so that everyone is on the same proverbial page. The course strives to provide more than simply what is written in the rules, and discusses the ways in which both case law and real-world practice affect and use the rules in a deposition. We will discuss why to take a deposition; how to take a deposition; when, why and how to object during a deposition; and, discuss a little of the privileges that can be asserted during a deposition. This course will hopefully make you laugh, not make you cry, and make you a little better at this thing called a deposition.
