Enforcement of the Foreign Corrupt Practices Act (FCPA) continues to be a top priority for the Department of Justice (DOJ), the Securities and Exchange Commission (SEC), and other regulators around the world. FCPA enforcement settlements in this area continue to set records, as evidenced by the recent $1.6 billion Siemens AG payment to the DOJ, the SEC and the Munich prosecutor's office, and the company has ongoing investigations with other regulators. In addition, the DOJ just obtained a conviction in one of the few FCPA cases to go to trial. Join Tom Gorman as he analyzes current enforcement trends in this critical area and provides guidance for avoiding liability or at least mitigating it.
