The pandemics impact on contractual performance is likely to be felt for years, and courts will be grappling with claims where a party claims its performance was excused by virtue of COVID-19. This presentation will discuss force majeure provisions generally, and how they may apply to the pandemic. We will also discuss alternative theories such as impossibility and frustration of purpose.
