With bankruptcy filings increasing, and many large corporations pursuing or considering Chapter 11 reorganization, numerous issues are arising in the intersection of environmental law and bankruptcy law. In the pending ASARCO bankruptcy, for example, the parties have addressed over 100 contaminated sites. In this program, from Celesq®'s new Environmental Law series, Joel Gross addresses the issues that arise in this area and how they are being dealt with by practitioners and the courts. Issues include the effect of the automatic stay on environmental obligations, what environmental obligations can be discharged, environmental disclosure in bankruptcy and the estimation of contingent environmental claims.
