Class action waivers and mandatory arbitration clauses in consumer, employment, and service contracts do not always generate the cost savings businesses hope for. Instead of a class action, defendants may face thousands of simultaneous individual demands for arbitration—Mass Arbitration—which can result resulting in significant costs and payment of nonrefundable fees. 

Mass arbitration is a new model of claiming that is both individualized and aggregate in nature. It raises a number of novel legal issues not yet resolved by courts and arbitrators, and it presents challenges for arbitral fora and arbitration protocols. 

This course on Mass Arbitration will be conducted by Professor Maria Glover of Georgetown University Law Center, who has completed the first and only comprehensive case study of mass arbitration, which is forthcoming in the Stanford Law Review. 

This course will provide an overview of mass arbitration, its key features and elements, the practical challenges it presents for claimants and defendants, and the unanswered legal questions lawyers and judges must confront. Professor Glover will also offer her thoughts on the future of mass arbitration.
