This Webinar will examine the lessons that can be derived from the 2002 Microsoft litigation for the current, ongoing Google litigation in the U.S. District Court of the District of Columbia, as it affects consumers, competitors and other dominant hi-tech companies.

Some of the questions to be discussed are:

  • What are the monopolization allegations under Section 2 of the Sherman Act contained in the Amended Complaint filed by the U.S. Department of Justice and the 14 States?
  • What is the state of the antitrust law that affects hi-tech companies?
  • What impact will the Google litigation have on consumers and competitors?
  • Will a finding of Section 2 Sherman Act liability against Google result in a breakup of Google into two companies-one for general search services and another for search and text advertising?
  • What defenses are available to Google? Are there procompetitive justifications that Google will be able to successfully assert?
  • Will technological advances and innovations contribute to reducing the existing barriers to entry?
  • What business practices has Google changed in order to rebut the claim of it possessing monopoly power?
