In the last 20 years, our profession has devoted a great deal of attention to the mental health of attorneys.

This presentation goes beyond outmoded fear-based discussions of statistics and answers real questions about how we can help ourselves and others. We will also recognize that very real ethics issues are presented, ranging from an individual lawyer’s obligation to clients, a colleague’s obligations regarding other attorneys, and, in a “flip” of the issue, the challenges presented in representing clients with mental health impairments.

ABA rules discussed:

  • (including new comment not contained in ABA rules but adopted by some states and being considered by others), 1.6, 1.14, 5.1, 8.3.
