The presentation will focus on the recent New York Court of appeals decision in Matter of TCR Sports Broadcast Holding v WN Partners et al, (2021 Slip OP 02090) resolving a nine-year arbitration dispute between the Washington Nationals and the Baltimore Orioles over the value of telecasting rights. The discussion will focus on some of the broader issues concerning the interplay of when can an arbitration award be vacated on the ground of “evident partiality” with the selection of an industry insider as the arbitrator.
