This presentation will provide an overview of trademarks including the nuts and bolts of trademark selection, filing, use, and maintenance, as well as pitfalls to avoid in each step of the process. This presentation will help you to understand how to define a trademark, evaluate trademark strength, walk through the trademark filing process, and discuss possible pitfalls in the trademark process. The presentation also will address the risks in using another’s trademarks and/or comparing products in advertising, and then conclude with a discussion of several court decisions that advise as to what marks are protectable and the likelihood of confusion test used in determining whether a mark is registrable and/or infringed.
