Description

The presentation will look at the current landscape in State and Federal Courts on standing in suits alleging statutory violations without consequential harm, such as those arising under the Illinois Biometric Information Privacy Act, state consumer protection statutes, as well as federal statutes like RESPA and FACTA. The presentation will cover a history of the standing doctrine, recent relevant decisions, and what is on the horizon, including relevant United States Supreme Court cases. The presenters will offer perspectives from both sides of the bar.

Jason Stiehl, Esq.

Jason Stiehl is an experienced trial lawyer focusing on consumer class action defense and complex commercial disputes involving trade secrets and restrictive covenants, unfair competition, corporate espionage, contracts and intellectual property claims.

Jason has represented clients in numerous nationwide class action matters, including multi-district cases involving claims of consumer fraud and alleged violations of the Telephone Consumer Protection Act (TCPA), the Electronic Funds Transfer Act (EFTA) and state and federal antitrust laws. He has obtained and defended preliminary and permanent injunctions in several jurisdictions across the country. At the appellate level, he has briefed and argued matters before several federal circuit courts and the Illinois Supreme Court.

In addition to his litigation practice, Jason counsels clients on managing restrictive covenant obligations and on creating policies and procedures related to the protection of trade secrets and corporate assets. He works with clients in a wide range of industry sectors, including pharmaceutical and medical equipment, banking, manufacturing, advertising, real estate, technology, transportation and automotive.

J. ELI WADE-SCOTT is an Associate at Edelson PC where his practice focuses on privacy- and tech-related class actions and enforcement actions brought by governmental entities. Eli is currently litigating over a dozen privacy class actions on behalf of consumers and employees under Illinois law, and has been appointed a Special Assistant State’s Attorney to prosecute Facebook’s violations of the Illinois Consumer Fraud Act in the Cambridge Analytica scandal.

Before joining Edelson, Eli served as a law clerk to the Honorable Rebecca Pallmeyer of the Northern District of Illinois. Eli has also worked as a Skadden Fellow at LAF, Cook County’s federally-funded legal aid provider. There, Eli represented dozens of low-income tenants in affirmative litigation against their landlords to remedy dangerous housing conditions.

During law school, Eli was an Executive Editor on the Harvard Law and Policy Review and a research assistant to Professor Vicki C. Jackson.
