Description

In part 2 of this two-part presentation, we will begin by discussing the patchwork of data privacy statutes, regulations and case law in an effort to define the baseline for reasonable security measures, and then apply these standards to recent breach events in the medical, construction, agricultural, retail, manufacturing, financial and legal industries to highlight common security failures, and opportunities for improvement. At the conclusion of the presentation, we will discuss best practices to consider to assist in reducing the risk of data breach incidences as well as the potential exposure in the event an incident occurs.

Michael A. Goode, Esq.

Goldberg Segalla

Michael A. Goode focuses his practice on workers’ compensation defense and general risk management counsel. He represents large counties, municipalities, and other governmental entities as well as clients in the retail, manufacturing, transportation, and construction industries. He has successfully represented a wide variety of clients, from large, self-insured retention employers to employers insured through carriers, throughout all of North Carolina. Michael is involved in every stage of the claims process, from inception through resolution, including all aspects of negotiation, litigation, contract management, mediation, hearings, and depositions. Michael has handled cases at all levels before the North Carolina Industrial Commission and the North Carolina Court of Appeals. A Certified Information Privacy Professional, Michael is also a member of the firm’s Cybersecurity and Data Privacy team and a contributor to Goldberg Segalla’s Data Privacy and Security blog.

 

James M. Paulino II, Esq.

Goldberg Segalla

James M. Paulino II represents individuals and corporations in complex insurance coverage, intellectual property, cyber risk, labor and employment, and professional malpractice matters, as well as domestic and international contract disputes. His experience includes numerous mediation and settlement negotiations, including the negotiation of a multimillion-dollar settlement, and both the prosecution and defense of personal injury and medical malpractice actions. Jimmy has defended numerous medical providers, including a major university hospital, against malpractice actions regarding a wide range of treatments and services — handling motion practice, discovery, medical records review, depositions, and trial preparation. A Certified Information Privacy Professional, Jimmy is also a member of the firm’s data breach litigation team and is a frequent contributor to Goldberg Segalla’s Data Privacy and Security blog. He teaches continuing-education courses on cyber security as a Lawline faculty member.
