Employers increasingly find themselves having to investigate workplace misconduct. Whether the internal investigation involves sexual harassment, defalcation, diversion of trade secrets, or other impropriety, its competence will have substantial consequences for the person being investigated and the employer. Just as a good investigation may provide a legal defense to some claims, a defective investigation can result in liability for the employer. How to plan for, conduct and document an investigation takes skill and training. It is no longer acceptable to entrust an investigation to an employer official who is learning on the fly.

In this program, Bruce Alper and Kevin Hennessy, two expert presenters who have assisted employers perform hundreds of investigations of all types, show how an investigation can protect or harm an employer and provide practical direction on how to properly investigate the most common workplace problems. Among other things, they discuss how to plan an investigation before talking to the first witness; how to interview the subject of the investigation; how to deal with uncooperative witnesses; and how to prepare documentation that does not contain damaging admissions.
