Legal Crisis Management: What Every General Counsel Should Know to Forestall a Crisis, or Address if it Occurs

Program Number: 2070

Program Date: 12/08/2010

Description

A corporate crisis, be it a failed product or service, an allegation of criminal conduct, a major accounting error or restatement, or an employment-related scandal, can result in serious and even irreparable damage to a company's brand and bottom line through increased legal liability, business interruption and a loss of customer and investor confidence. This program, presented by Lanny Davis, former Special Counsel to President Clinton; William Weld, former Governor of Massachusetts; Stephen Ryan and Eileen O’Connor, offers tips on what every General Counsel must consider to prevent and prepare for such a crisis, from ensuring regulatory compliance programs are vigorous and employees properly trained in complying with relevant legal requirements, to tips on 'handling' the company's media and internal communications in a way that satisfies legal requirements while saving a corporation's reputation and business plan.

Lanny J. Davis, Esq., the founder of Lanny J. Davis & Associates LLC, counsels individuals, corporations and government contractors, and those under congressional scrutiny, on crisis management and legal issues by developing legal, media and legislative strategies that are designed to best produce a successful result for the client. He has experience in securities fraud and SEC investigations as well, and has found that utilizing such an integrated legal/media/lobbying approach can lead to quicker and less expensive settlements or even successfully litigated outcomes. Senior officials of public companies have also hired Mr. Davis and his crisis group to defend themselves successfully against "short and distort" attacks and other market manipulations. For 25 years prior to 1996, before his tenure as special counsel to President Clinton, he was a commercial, antitrust, government contracts and False Claims Act litigator (both in defense as well as plaintiff).
