Asset protection practitioners and trustees must know how and when to spring into action in the event a litigation challenge or other threat arises against an integrated estate planning trust (“IEPT”) or a related entity. As time is often of the essence with respect to litigation challenges or other types of threats, Barry Engel provides an in-depth discussion related to the process of “protective measures” or “emergency measures” that can be undertaken by the trustees when plan assets are faced with a threat. Topics include: the various steps involved with trustee protective measures; the use of foreign custodians; foreign bank accounts and foreign funds managers; contempt of court issues and, importantly, avoiding contempt of court.
