By now, nearly everyone has heard of WikiLeaks. The organization claims to provide a safe haven for anonymous whistleblowing and it is reported to be sitting on a treasure trove of damaging information about U.S. corporations and executives. Copy-cat websites like OpenLeaks, RadioLeaks and LocalLeaks are now popping up around the globe offering their own online platforms for workers to leak sensitive information about their employers. The net effect will be to make anonymous publication of sensitive corporate information easier, safer and more widespread. In light of this emerging legal threat, Heather Egan Sussman and Obiamaka Madubuko, both partners at McDermott Will & Emery, provide inside and outside counsel with concrete strategies for mitigating risk of unwanted leaks and for helping clients to avoid becoming targets for the next public disclosure scandal.
