The U.S. Environmental Protection Agency has identified the enforcement of financial assurance requirements as a "National Priority" through fiscal year 2010, and its Financial Advisory Board has been actively examining the issue. Financial assurance is required under several statutory regimes, including Superfund, RCRA and underground storage tank regulations, yet many regulated companies are unfamiliar with—or even unaware of—their obligations.
