Over the past year, as the use of social media has grown, we have seen a continuing evolution of attendant privacy protections, corporate risks and liabilities. The use of social media in the workplace—as a way to communicate with colleagues and customers—has resulted in new risks and pushed companies to make new rules. Our court systems themselves even face significant social media challenges, as judges impose restrictions on jurors texting and tweeting during trials. Join Matt Karlyn and Michael Pontrelli of Foley & Lardner LLP as they discuss the ethics of social media, the impact social media is having on complex commercial litigation, and some predications for what the future may hold. The focal point will be legal ethics, including both old and new ethical issues faced by in-house and outside counsel stemming from the uses made of social media--in the workplace itself, in dealing with customers and other outside parties, and in managing litigation.
